Terms of Use
These terms are an agreement between you and Efe Onur Özcandan, trading as Late Lamp ("Late Lamp", "we", "us"), about your use of the Whereabouts app (the "Game"). Our address is in section 16. By installing or playing the Game you accept these terms. If you do not agree, do not use the Game.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for your own entertainment. You may not copy, modify, sell, rent, distribute, reverse-engineer, or create derivative works from the Game or its content, except where the law expressly allows it.
2. Who may play
The Game contains a fictional murder-mystery theme and is intended for players aged 13 and over. If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf and is responsible for any purchases.
3. Gold, tools, and hearts
- Gold is the Game's virtual currency. Tools (hints such as Next Lead or Mark Check) and hearts are virtual items. You earn them by playing or buy them with real money through the app store.
- Virtual currency and items have no monetary value, are not your property, cannot be exchanged for real money or transferred to anyone else, and are licensed to you for use in the Game only.
- We may change how much things cost in gold, how hearts refill, what tools do, and the contents of packs, to keep the Game balanced. We may remove or replace virtual items when the Game changes.
- Progress and virtual items are stored on your device. If you delete the Game or lose the device, progress that was not restored through a purchase may be lost. Purchases can be restored as described below.
4. Detective's Badge subscription
The Detective's Badge is an auto-renewing subscription that removes the hearts limit and adds the other benefits shown on the purchase screen.
- Plans. The Badge is offered as a weekly plan and an annual plan. The price for each is shown in the Game before you buy and is charged in your local currency.
- Free trial. The annual plan may include a free trial. When the trial ends, your app store account is charged the annual price unless you cancel at least 24 hours before the trial ends. Only one free trial is available per account.
- Automatic renewal. Subscriptions renew automatically at the end of each period at the same price unless cancelled at least 24 hours before the current period ends. Your app store account is charged for the renewal within 24 hours before the period ends.
- Managing and cancelling. You manage and cancel the subscription through your app store account, not in the Game: on iOS, Settings › your name › Subscriptions; on Android, the Google Play app under Payments & subscriptions. Cancelling stops future charges; you keep the Badge until the end of the period you already paid for. Deleting the Game does not cancel a subscription.
- Price changes. If we change the price of a plan, the app store will tell you in advance and, where the law or the store requires it, ask for your consent before the new price applies.
5. Purchases and refunds
All purchases are made through Apple's App Store or Google Play and are subject to their payment terms. We do not process payments or hold your payment details. Refunds are handled by the store under its policies; on iOS use reportaproblem.apple.com. Except where the law requires otherwise, purchases of virtual items are final once delivered. Use Restore purchases in the Game's Shop to bring purchases to a new device signed in with the same store account.
6. Ads
This version of the Game shows no ads. A later version may add rewarded ads that you choose to watch; they would be served by third parties, we would not be responsible for their content, and how they use data would be explained in the Privacy Policy.
7. Fair play
You agree not to:
- use cheats, exploits, automation, or modified versions of the Game;
- interfere with the Game's services or purchase systems, or attempt to obtain virtual items without paying for them where payment is required;
- use the Game for anything unlawful.
8. Ownership
The Game, including its puzzles, stories, characters, artwork, music, sounds, code, and the Whereabouts name and logo, is owned by us or our licensors and protected by copyright and other laws. These terms do not give you any ownership of it. Feedback you send us may be used freely to improve the Game, without any obligation to you.
9. Changes to these Terms
We may update these terms, for example when the Game gains a feature. The new version is posted at latelamp.com/whereabouts/terms.html with a new effective date at the top. For significant changes we also show a notice in the Game at least 14 days before they take effect; changes required by law or tied to a new feature may take effect sooner. If you keep playing after the effective date, the new terms apply. If you do not agree, stop playing and cancel any subscription. For an existing subscription, a change that reduces what you get applies from the next renewal.
10. Changes to the Game
We may update, change, or discontinue the Game or any part of it, including cases, features, virtual items, and prices, at any time. We will try to give notice of significant changes in the Game, and we will not charge you for a subscription period during which the Game is discontinued.
11. No warranty
The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not promise that the Game will be uninterrupted, error-free, or available on any particular device. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost progress, or lost virtual items, arising from your use of the Game. Our total liability for any claim relating to the Game is limited to the amount you paid us for the Game in the twelve months before the claim, or, if you paid nothing, to ten US dollars or the equivalent in your currency. Some jurisdictions do not allow these limitations, so they may not apply to you.
13. Termination
You may stop using the Game at any time by deleting it. We may suspend or end your license if you break these terms. On termination the license ends, and you lose access to virtual items, which have no monetary value. Sections 3, 8, 11, 12, and 15 survive termination.
14. App Store and Google Play terms
If you downloaded the Game from Apple's App Store, Apple's Licensed Application End User License Agreement also applies, and where it conflicts with these terms it prevails to the extent of the conflict. In addition:
- Parties. These terms are between you and us, not Apple. Apple is not responsible for the Game or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- Scope. The license in section 1 covers use of the Game on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms, including by other accounts associated with yours through Family Sharing or volume purchasing.
- Maintenance and support. We, not Apple, are responsible for any maintenance and support of the Game. Apple has no obligation to provide any.
- Warranty. If the Game fails to conform to a warranty that applies, you may notify Apple, and Apple will refund the price you paid for the Game, if any. To the fullest extent permitted by law, Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost, or expense attributable to a failure to conform to a warranty is our responsibility.
- Claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to the Game or your use of it, including product liability claims, claims that the Game fails to meet a legal or regulatory requirement, and consumer protection or similar claims.
- Intellectual property. If a third party claims that the Game infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement, and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any third-party terms that apply when you use the Game.
If you downloaded the Game from Google Play, the Google Play Terms of Service also apply.
15. Governing law
These terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, and disputes will be brought in the courts of Türkiye, except where mandatory consumer law gives you the right to rely on the law and courts of your own country of residence. If any part of these terms is found unenforceable, the rest remains in effect. These terms are the entire agreement between you and us about the Game. The Privacy Policy explains how we handle data; it is a notice about our practices, not part of this agreement.
