By downloading, installing, accessing or using the Whereabouts mobile application through the Apple App Store or Google Play (“Whereabouts” or the “Application”), these terms and conditions, including the End-User License Agreement set out below (together, the “Terms and Conditions”), will automatically apply to you – you should therefore make sure that you read them carefully before using Whereabouts.
Whereabouts is a single-player murder-mystery logic puzzle game in which the user places suspects on a board according to the clues given in each case, together with a daily case whose results are ranked on a world board (the “Services”). These Terms and Conditions only grant you the right to use Whereabouts in order to benefit from the Services within the scope defined herein. You are not allowed to copy or modify Whereabouts, any part of Whereabouts, or our trademarks in any way. You are not allowed to attempt to extract the source code of Whereabouts, and you also should not try to translate Whereabouts into other languages or make derivative versions. Whereabouts itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, remain the property of Efe Onur Özcandan, doing business as Late Lamp (“Late Lamp”).
Late Lamp is committed to ensuring that Whereabouts is as enjoyable and as reliable as possible. For that reason, we reserve the right to make changes to Whereabouts or to charge for its services, at any time and for any reason. We will never charge you for Whereabouts or its Services without making it very clear to you exactly what you are paying for.
Whereabouts stores your game progress on your device, keeps your daily case results on our server under an anonymous player identity, and processes the technical and usage data described in the Privacy Policy in order to provide and improve the Services. It is your responsibility to keep your phone and your access to Whereabouts secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware, viruses or malicious programs, compromise your phone’s security features, and it could mean that Whereabouts will not work properly or at all.
You should be aware that there are certain things that Late Lamp will not take responsibility for. Certain functions of Whereabouts, in particular making and restoring purchases, receiving remote configuration and updates and playing the daily case with a ranked result, require Whereabouts to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Late Lamp cannot take responsibility for Whereabouts not working at full functionality if you do not have access to Wi-Fi and you do not have any of your data allowance left.
If you are using Whereabouts outside of an area with Wi-Fi, you should remember that the terms of your agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing Whereabouts, or other third-party charges. In using Whereabouts, you accept responsibility for any such charges, including roaming data charges if you use Whereabouts outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you are using Whereabouts, please be aware that we assume that you have received permission from the bill payer for using Whereabouts.
At some point, we may wish to update Whereabouts. Whereabouts is currently available on iOS and Android – the requirements for the system (and for any additional systems we decide to extend the availability of the Application to) may change, and you will need to download the updates if you want to keep using Whereabouts. Late Lamp does not promise that it will always update Whereabouts so that it is relevant to you and/or works with the iOS or Android version that you have installed on your device. However, you agree to accept updates to the Application when offered to you. We may also wish to stop providing Whereabouts and may discontinue it at any time; we will endeavour to give you notice within the Application, as set out in Article 5.5 of the End-User License Agreement. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these Terms and Conditions will end; (b) you must stop using Whereabouts and, if needed, delete it from your device.
We may update these Terms and Conditions from time to time, for example when Whereabouts gains a feature or when the law requires it. The updated Terms and Conditions will be posted at latelamp.com/whereabouts/terms.html with a new Update Date. For significant changes we will also display a notice within the Application at least 14 (fourteen) days before they take effect; changes required by law or tied to a new feature may take effect sooner. If you continue to use Whereabouts following the publication of the updated Terms and Conditions, you shall be deemed to have accepted the changes. If you do not agree to the changes, you must stop using Whereabouts and cancel any subscription. For an existing subscription, a change that reduces what you receive applies only from the next renewal.

LATE LAMP END-USER LICENSE AGREEMENT
This End-User License Agreement (the “Agreement”) is a legal agreement between you and Late Lamp. Please read this Agreement carefully. By Using (as defined under Article 1) Whereabouts, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not Use Whereabouts.
This Agreement forms an integral part of the Terms and Conditions.
1.1.This Agreement governs your downloading, installation, access to and use (together, “Use” or “Using”) of the Whereabouts mobile application, including all of its content, cases, features, updates, upgrades and any related documentation (“Whereabouts” or the “Application”), published by Late Lamp through the Apple App Store and Google Play (together, the “App Stores”).
1.2.“User” or “you” refers to the natural person who Uses the Application. “Virtual Items” refers to the gold (the virtual currency of the Application), the tools (hints such as Next Lead, Check, Reveal or Unmask), the coffee and any other virtual good, currency or feature that is earned within or purchased for the Application. “Subscription” refers to the Bottomless Cup auto-renewable subscription described in Article 14.
1.3.Whereabouts is a single-player game. It does not provide user accounts and does not require registration. The daily case (Article 7) uses an anonymous player identity that the Application creates on your device and a detective name that you choose; the detective name is the only content you can enter into the Application and the only content shown to other Users. Your game progress and your Virtual Items are stored on your device, your daily case results are stored on our server under the anonymous player identity, and your Subscription is recorded by the App Stores and by our purchase-validation provider so that it can be restored on a new device.
1.4.By Using the Application, you represent and warrant that you have the legal capacity to enter into this Agreement in the jurisdiction in which you reside, or that your parent or legal guardian has agreed to this Agreement on your behalf (see Article 2.4).
1.5.The Privacy Policy explains how Late Lamp processes personal data in connection with the Application. The Privacy Policy is a notice regarding our practices and does not form part of this Agreement.
2.1.This Agreement is concluded between Late Lamp and the User who has downloaded and/or installed the Application through the App Stores, and enters into force upon the User’s downloading, installation, access to or use of the Application. Late Lamp and the User shall hereinafter be referred to individually as the “Party” and collectively as the “Parties”.
2.2.By downloading and/or installing the Application through the App Stores or by accessing and/or using the Application, the User agrees, undertakes and represents that he/she has read all the terms herein, understood all the contents and approved all provisions.
2.3.In case the User is a “consumer” under the Consumer Protection Law of Türkiye No. 6502 (“Law No. 6502”), the consumer legislation of the European Union or the United Kingdom, or any other applicable consumer legislation, the User can benefit from the rights and powers vested in consumers thereunder to the extent applicable. Nothing in this Agreement limits any right of the User that cannot be limited or waived by contract under the applicable consumer legislation.
2.4.The Application has a fictional murder-mystery theme and is intended for Users aged 13 (thirteen) and over. If you are under the age of majority in the jurisdiction in which you reside, you may Use the Application only if your parent or legal guardian has reviewed and agreed to this Agreement on your behalf, and your parent or legal guardian is responsible for your Use of the Application and for any purchases made through it.

4.1.Subject to your compliance with this Agreement, Late Lamp grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to download, install and Use the Application on mobile devices that you own or control, solely for your own personal, non-commercial entertainment purposes and in accordance with the usage rules of the relevant App Store.
4.2.The Application is licensed, not sold, to you. Late Lamp reserves all rights not expressly granted to you under this Agreement. You may not Use the Application if you obtained it from any source other than the App Stores or through an unauthorized distributor.
5.1.You may not, and you may not permit any third party to: (i) copy, reproduce, distribute, publish, sell, rent, lease, lend, sublicense or otherwise transfer the Application or any part of it; (ii) modify, adapt, translate or create derivative works of the Application; (iii) reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, assets or algorithms of the Application, except to the extent expressly permitted by the applicable law; (iv) remove, alter or obscure any proprietary notice on the Application; or (v) Use the Application for any purpose that is unlawful or prohibited by this Agreement. Violations of the foregoing may result in civil and criminal law remedies.
5.2.You may not use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify the Application, to interfere with its purchase, configuration or daily case systems, to obtain Virtual Items or Subscription benefits without paying for them where payment is required, or to obtain a daily case result or ranking that you did not achieve by playing. You may not access the Application or its connected services in an automated manner by preparing automatic programs.
5.3.Late Lamp may, at its sole discretion and without notice, add, modify, rebalance or remove cases, features, difficulty tiers, prices in virtual currency, the rate at which coffee brews, the function of tools and the contents of packs, in order to keep the Application balanced and to improve it. Some Users may see a different version of a feature than others (A/B tests).
5.4.The Application may from time to time download and install updates, upgrades and remote configuration from Late Lamp or the App Stores. You agree that Late Lamp may require you to install the latest version of the Application in order to continue Using it, and that Late Lamp may discontinue support for older versions of the Application or of the operating system.
5.5.Late Lamp reserves the right to suspend, limit or discontinue the Application or any part of it, including its connected services, at any time. Late Lamp will endeavour to give notice of significant changes within the Application and will not charge you for a Subscription period during which the Application is discontinued.
5.6.Defective Content: Once the Application or an in-app product is available to you, you are required to check it as soon as reasonably possible to ensure that it works as described, and to notify Late Lamp at support@latelamp.com if you find any errors or defects, so that Late Lamp can investigate and remedy them.
5.7.Pre-release versions. Late Lamp may make pre-release (beta) versions of the Application available by invitation through Apple’s TestFlight or Google Play’s testing tracks. Beta versions are provided for testing only: they may contain errors, may be changed or withdrawn at any time, and progress, Virtual Items and results made in a beta version may not carry over to the released Application. A beta version asks for your name and e-mail address before it can be played and records how it is used under that name, as described in the Privacy Policy (Section 2, “Beta programme”); by signing in you confirm that you have read that section. The terms of TestFlight or of Google Play testing apply in addition. Purchases in a beta version are made through the test environment of the relevant App Store where one is provided and are otherwise real purchases subject to Article 14.
6.1.The Application may make available Virtual Items, which you can earn by playing or purchase with real money through the App Stores. Virtual Items are licensed to you under this Agreement for use within the Application only.
6.2.Virtual Items have no monetary value, are not your property, cannot be redeemed or exchanged for real money, goods or services, cannot be transferred, traded, sold or given to any other person, and are not refundable except as required by the applicable law or the policies of the App Stores.
6.3.Late Lamp may modify, regulate, control or remove Virtual Items at any time, with or without notice, and shall have no liability to you or any third party in respect thereof, to the extent permitted by the applicable law. Late Lamp may set limits on the amount of Virtual Items that may be held or used within a period.
6.4.Game progress and Virtual Items are stored on your device. If you delete the Application, reset your device or lose it, your game progress and your Virtual Items may be lost, and Late Lamp is not able to recover them. Gold packs and bundles are consumed on delivery and cannot be restored by the App Stores. An active Subscription can be restored on a device signed in with the same App Store account by using Restore purchases in the shop screen of the Application. Your daily case results are stored on our server under the anonymous player identity of your installation (Article 7.5).
7.1.Once the daily case is unlocked, the Application offers each day (the day changes at 00:00 UTC) a set of boards that are the same for every User and that can each be attempted once. The attempt is spent when the board is opened after the START confirmation; leaving the board, closing the Application or losing all hearts during the attempt ends it as failed, and the board cannot be reopened that day. Late Lamp does not restore spent attempts.
7.2.Results are ranked by solve time on a world board that is visible to every User and shows, for each attempt, the detective name, the country flag and the time or the outcome. By starting a daily board you accept that this information is shown to other Users. The Application must be connected to the internet when the board is started for the result to be ranked; a board played offline is played unranked and does not appear on the world board.
7.3.Detective names. The detective name you choose must not be your real name or the name of another real person; must not be offensive, obscene, hateful, discriminatory or threatening; must not impersonate Late Lamp, its staff or another User; must not contain links, advertising or contact details; and must not infringe the rights of any third party. Late Lamp may refuse, change or remove a detective name and remove the associated rows from the world board at any time and without notice.
7.4.Fair play. Each User may play each daily board once, on one device. You may not manipulate the clock or the date of your device, the network traffic of the Application, the Application itself or its connected services in order to obtain, improve or repeat a result. Late Lamp may, at its sole discretion and without notice, remove results, exclude a player identity from the world board, reset or void a day’s board, or correct the ranking, in particular where it detects cheating, a technical fault or a board that turned out to be defective.
7.5.Rankings, results and detective names have no monetary value, confer no right or entitlement and are not your property; Virtual Items awarded for a daily case are subject to Article 6. The world board is a connected service within the meaning of Article 5.5 and may be changed, suspended or discontinued. Your results are stored under an anonymous player identity that is bound to your installation of the Application: deleting the Application ends your access to that identity, a new installation starts with an empty record, and Late Lamp cannot attach earlier results to a new installation. Rows already filed are deleted automatically after 12 (twelve) months, or earlier at your request, as described in the Privacy Policy.
8.1.The Application is distributed by, and purchases within the Application are processed and billed by, the App Stores. Purchase validation is performed by RevenueCat, Inc., product analytics, session recordings and feature configuration are provided by PostHog, Inc., the measurement of our advertising campaigns (whether an installation followed an advertisement of ours) is performed by Meta Platforms, Inc., and the anonymous player identity of the daily case is issued by Firebase Authentication and our own server for the daily case is hosted on Google Cloud, both services of Google LLC (together with the App Stores, the “Third-Party Partners”).
8.2.Your use of the App Stores is subject to the terms and conditions of Apple Inc. and Google LLC respectively, which you must comply with. Late Lamp is not a party to those terms and is not responsible for the App Stores or their services.
8.3.The processing of personal data by the Third-Party Partners is described in the Privacy Policy and in the privacy policies of the respective Third-Party Partners. Late Lamp is not responsible for the content, terms or practices of any third-party website or application linked from the Application.
8.4.This version of the Application does not display advertisements. Late Lamp advertises the Application on third-party platforms, and the Application may report to Meta Platforms whether your installation followed such an advertisement, subject to your choices on the consent screen, in the Settings screen of the Application and, on iOS, under Apple’s tracking permission, as described in the Privacy Policy. Should a later version include rewarded advertisements that you choose to watch, they would be served by third-party advertising networks; Late Lamp would not be responsible for their content, and the processing of data in connection with them would be described in the Privacy Policy before any such advertisement is shown.
9.1.Late Lamp and its Third-Party Partners take reasonable technical and administrative measures to protect the Application and the data connected with it. However, no transmission over the internet and no method of electronic storage can be regarded as 100% secure, and Late Lamp cannot guarantee the absolute security of the Application or of any data transmitted through it.
9.2.You are responsible for the security of your mobile device, of your App Store account and of the Application data stored on your device, including maintaining the security features of the operating system and not installing the Application on a jailbroken or rooted device.
9.3.If you become aware of any security vulnerability or unauthorized use of the Application, please notify Late Lamp at support@latelamp.com.
10.1.You may stop Using the Application at any time by uninstalling it from your device. Uninstalling the Application deletes the game progress and settings stored on your device, including the anonymous player identity of the daily case; rows already filed on the world board are deleted automatically after 12 (twelve) months, or earlier at your request (Privacy Policy, Section 6).
10.2.Uninstalling the Application does not cancel an active Subscription. You must cancel the Subscription through your App Store account as described in Article 14.4 in order to stop future charges.
11.1.You acknowledge that Late Lamp processes the technical, usage and transaction data described in the Privacy Policy in order to operate, secure, measure and improve the Application, in accordance with the applicable data protection legislation.
11.2.If you submit reviews, ratings, suggestions, ideas, bug reports or other feedback relating to the Application, whether through the App Stores, the beta programme, by e-mail or by any other means (“Feedback”), you grant Late Lamp a non-exclusive, irrevocable, fully paid, royalty-free, perpetual, sublicensable, transferable and worldwide license to use, reproduce, modify, publish and otherwise exploit the Feedback for the purpose of operating, improving and promoting the Application and the existing and future products of Late Lamp, without notice, permission, payment or any additional compensation to you or a third party. Late Lamp is under no obligation to use any Feedback.
12.1.The Application, including but not limited to its puzzles, cases, stories, characters, names, dialogue, artwork, illustrations, animations, user interface, music, sound effects, software, source code, object code, databases and documentation, and the “Whereabouts” and “Late Lamp” names, logos and marks (collectively, the “Intellectual Property Rights”), are owned by Late Lamp or its licensors and are protected by copyright, trademark and other intellectual property laws and international treaties.
12.2.This Agreement does not grant you any right, title or interest in the Intellectual Property Rights other than the limited license set out in Article 4. All rights not expressly granted are reserved by Late Lamp and its licensors.
12.3.You may not use the names, logos or marks of Late Lamp or Whereabouts without the prior written consent of Late Lamp, except as reasonably necessary to identify the Application in a review or in ordinary personal communication. Recording, streaming or publishing videos and screenshots of your own gameplay for personal, non-commercial purposes is permitted, provided that the Application is not misrepresented and that your content is not presented as official content of, or as endorsed by, Late Lamp.
13.1.Late Lamp respects the intellectual property rights of others. If you believe that any content in the Application infringes your copyright, trademark or other rights, please notify Late Lamp at support@latelamp.com with a description of the content, the right you claim to be infringed, your contact details and a statement that the information in your notice is accurate. Late Lamp will investigate and take the appropriate steps.
13.2.Late Lamp reserves the right to take any legal action against Users who infringe the Intellectual Property Rights of Late Lamp or its licensors, including the termination of this Agreement under Article 15.
14.1.The Application can be downloaded and played free of charge. Whereabouts nevertheless offers certain features, Virtual Items and the Subscription to the User as paid features. If the User would like to use such paid features under this Agreement, the User will first need to make payment through the relevant App Store before accessing the paid feature. The price of each paid feature is displayed within the Application before you buy and is charged in your local currency.
14.2.Subscription. Bottomless Cup is an auto-renewable Subscription that removes the coffee limit, makes hints unlimited and provides the other benefits shown on the purchase screen of the Application. The Subscription is offered on a weekly basis and on an annual basis. The Subscription will be re-billed at the end of each period for the same period and at the same price, until cancelled by the User. Your App Store account is charged for the renewal within 24 (twenty-four) hours before the end of the current period.
14.3.Free trial. The annual plan may include a free trial. When the trial ends, your App Store account is charged the annual price unless you cancel the Subscription at least 24 (twenty-four) hours before the end of the trial. Only one free trial is available per App Store account. Any unused portion of a free trial is forfeited when you purchase a Subscription.
14.4.Managing and cancelling. The Subscription is managed and cancelled through your App Store account, not within the Application: on iOS, under Settings › your name › Subscriptions; on Android, in the Google Play application under Payments & subscriptions. Cancellation takes effect at the end of the current period; you keep the Subscription benefits until then, and no refund is made for the remainder of the current period except as required by the applicable law or the policies of the relevant App Store. Uninstalling the Application does not cancel the Subscription.
14.5.Billing by the App Stores. The in-app purchases and the Subscription are purchased from and billed by the relevant App Store, not by Late Lamp. These purchases are subject to the terms and conditions of the relevant App Store. All billing and refund inquiries shall be directed to the relevant App Store; on iOS, refund requests are made at reportaproblem.apple.com, and on Android through the Google Play help centre. Late Lamp does not have access to your App Store account, does not process payments and does not receive or store your card or bank details. You are responsible for all amounts payable associated with purchases made through your App Store account.
14.6.Right of withdrawal. In some countries, the law provides consumers with a specific period in which to cancel online purchases after making them (for example, residents of the European Union, the United Kingdom and Türkiye). Since the payment processes of purchases within the Application are conducted by the App Stores, the exercise of any such right of withdrawal is subject to the terms of the relevant App Store, which you should review before purchasing. To the extent permitted by the applicable law, by purchasing Virtual Items or a Subscription you request that the digital content be delivered immediately and acknowledge that you lose your right of withdrawal once the delivery has begun. Except where the law requires otherwise, purchases of Virtual Items are final once delivered.
14.7.If you are under 18 (eighteen), you are legally required to have your parents’ or legal guardians’ permission to make any purchases. By completing a purchase, you confirm to us that you have any and all permissions that may be necessary in order to allow you to make that purchase. If you are a parent or legal guardian of someone under the age of 18, we recommend that you consider the parental controls provided by the App Stores if you are concerned that your child may make excessive purchases.
14.8.Provided that it is not due to the User, to the device used by the User or to the technical characteristics of that device, if any purchase is not successfully completed or the purchased feature does not work as described once the purchase is completed, Late Lamp will, after becoming aware of the issue or being notified of the issue by you at support@latelamp.com, investigate the issue and, where the purchase is confirmed by the relevant App Store, deliver the purchased feature or assist you in obtaining a refund from the relevant App Store.
14.9.Price changes. Late Lamp may change the price of the Subscription or of any paid feature. If the price of your Subscription changes, the relevant App Store will notify you in advance and, where the applicable law or the App Store requires it, will request your consent before the new price applies. If you do not agree to the new price, you may cancel the Subscription before it takes effect.
15.1.This Agreement is effective from the moment you first Use the Application and remains in force until terminated by you or by Late Lamp.
15.2.You may terminate this Agreement at any time by uninstalling the Application and, if applicable, cancelling your Subscription.
15.3.Late Lamp may terminate this Agreement or suspend your license to Use the Application, with or without notice, if you breach any provision of this Agreement, if Late Lamp is required to do so by law, or if Late Lamp discontinues the Application.
15.4.Upon termination, the rights and licenses granted to you under this Agreement will end, you must cease all Use of the Application and uninstall, remove or destroy all copies of the Application in your possession or control, and you will lose access to any Virtual Items, which have no monetary value. The User agrees that Late Lamp shall not be liable to the User or any third party for any termination or disabling of the Application, except as provided in Article 5.5 and as required by the applicable consumer legislation. Termination shall not limit any of Late Lamp’s other rights or remedies at law.
15.5.Articles 6, 7, 11, 12, 16, 17, 18, 20 and 22 shall survive the termination of this Agreement.
16.1.To the extent permitted by the applicable law, you agree to indemnify and hold harmless Late Lamp and its licensors, contractors, agents and third-party service providers (collectively, the “Indemnitees”) from any and all claims, liabilities, costs and expenses, including reasonable attorneys’ fees (collectively, “Claim(s)”), that actually or allegedly and directly or indirectly result from your Use of the Application in breach of this Agreement or of the applicable law.
16.2.You agree to be solely responsible for defending any Claim against or suffered by any Indemnitee, subject to the relevant Indemnitee’s right to participate with counsel of its own choosing, and for the payment of damages or losses resulting from all such Claims against any Indemnitee, provided that you will not agree to any settlement that imposes any obligation or liability on any Indemnitee without Late Lamp’s prior express written consent. This Article does not apply to Users who are consumers to the extent that the applicable consumer legislation does not permit such an obligation.
17.1.To the extent this is permitted by the applicable law, the Application is provided on an “AS IS”, “WITH ALL FAULTS” and “AS AVAILABLE” basis and you use it at your sole risk. Subject to the applicable law, Late Lamp, on behalf of itself and its licensors, distributors, vendors, agents and suppliers, expressly disclaims any and all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement and any other warranty arising from the relevant legislation.
17.2.Without limitation, Late Lamp makes no warranty that the Application will meet your requirements, that it will be uninterrupted, timely, secure or error-free, that it will be compatible with any particular device or operating system version, that any defect will be corrected, or that the quality of the Application will meet your expectations. Late Lamp assumes no liability or responsibility for any damage to your device or loss of data resulting from the download or Use of the Application, except as provided in Article 18.
17.3.Nothing in this Article limits any warranty or guarantee that you have as a consumer under the applicable law and that cannot be excluded or limited by contract.
18.1.To the fullest extent permitted by the applicable law, in no event shall Late Lamp or the Indemnitees be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to lost profits, lost revenue, lost time, loss of use, loss of data, lost game progress, lost Virtual Items, loss of goodwill or other intangible losses, whether in contract, tort (including negligence), strict liability or under any other legal theory, arising out of or in connection with this Agreement or the Use of or inability to Use the Application, even if Late Lamp has been advised of the possibility of such damages.
18.2.To the fullest extent permitted by the applicable law, the total aggregate liability of Late Lamp for any and all Claims arising out of or in connection with this Agreement or the Application shall be limited to the total price of the in-app purchases and Subscription periods that you bought in the Application through the App Stores in the 12 (twelve) months preceding the event giving rise to the Claim, or, if you have paid nothing, to 10 (ten) US dollars or the equivalent in your local currency.
18.3.Nothing in this Agreement excludes or limits the liability of Late Lamp for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under the applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
19.1.If you downloaded the Application from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, and where it conflicts with this Agreement it prevails to the extent of the conflict. In addition, the following terms apply:
19.2.If you downloaded the Application from Google Play, the Google Play Terms of Service also apply to your download and Use of the Application, and Google LLC is not a party to this Agreement and is not responsible for the Application.
20.1.Late Lamp shall not be liable for any failure or delay in the performance of its obligations under this Agreement resulting from causes beyond its reasonable control, including but not limited to natural disasters, epidemics, war, terrorism, riots, strikes, governmental actions, failures of the internet, of telecommunications networks, of the App Stores or of the Third-Party Partners, or of power supply (each a “Force Majeure Event”). The obligations of Late Lamp shall be suspended for the duration of the Force Majeure Event.
20.2.This Agreement and the Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the competent courts and enforcement offices of the Republic of Türkiye.
20.3.Notwithstanding Article 20.2, if you are a consumer, nothing in this Agreement deprives you of the protection of the mandatory provisions of the consumer legislation of the country in which you habitually reside, and you may bring proceedings before the competent consumer courts or consumer arbitration committees of that country. Users residing in the European Union may also use the online dispute resolution platform of the European Commission.
21.1.Notices to Late Lamp shall be sent by e-mail to support@latelamp.com or by post to the address stated in Article 3. Notices to the User may be given by publishing them at latelamp.com/whereabouts, by displaying them within the Application, or, where the User has contacted Late Lamp, by e-mail to the address used by the User.
22.1.This Agreement, together with the Terms and Conditions of which it forms a part, constitutes the entire agreement between you and Late Lamp regarding the Application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding its subject matter.
22.2.If any provision of this Agreement is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of this Agreement shall continue in full force and effect.
22.3.The failure of Late Lamp to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Late Lamp may assign this Agreement, in whole or in part, to any successor or affiliate without your consent; you may not assign this Agreement without the prior written consent of Late Lamp.
22.4.This Agreement is drawn up in English and in Turkish (Turkish version: Kullanım Koşulları). For consumers resident in Türkiye the Turkish version prevails; for all other Users the English version prevails in case of any inconsistency, except where the applicable law requires otherwise.
